Racism at it's worst

"Congresswoman Cynthia McKinney, like thousands of average Americans across this country, is, too, a victim of the excessive use of force by law enforcement officials because of how she looks and the color of her skin. Ms. McKinney is just a victim of being in Congress while black," said Meyer.

Charges against McKinney could range from assault on a police officer, which is a felony carrying a possible five year prison term, to simple assault, which is a misdemeanor.

The six-term congresswoman apparently struck a Capitol Police officer when he tried to stop her from entering a House office building without going through a metal detector. Members of Congress wear identifying lapel pins and routinely are waved into buildings without undergoing security checks. The officer apparently did not recognize McKinney, she said in a statement. She was not wearing her lapel pin.

Let us review -

Ms McKinney walked around a security checkpoint.

Then she ignored the uniformed police officer who asked her to stop and identify herself.

When the officer touched her, to get her attention, she slapped a uniformed police officer.

But Ms McKinney is innocent by virtue of her race.

Ms McKinney needs to learn respect for proper authority, and she needs to set a better example. Ms McKinney teaches total disrespect for police and then she wonders why so many African-americans are in jail.

Sadly, there are only 14 black women Members of Congress. And surely our faces are distinguishable. But why my face is continually unrecognizable can only be answered by these offending police officers. Capitol Hill Police are given face recognition instructions as a part of their official training. Capitol Hill Police are required to recognize, greet, and distinguish Members of Congress as a part of their official role and responsibilities. In fact, according to the US Capitol Police, their mission is to protect and support the Congress in meeting its Constitutional responsibilities. The US Capitol Police mission statement makes no distinction about selective application of its mission depending upon whether a Member of Congress is black, woman, or has a new hairstyle.
But, honestly, this incident is not about wearing a Congressional pin or changing my hairstyle.

Sorry, Cynthia - As a Member of Congress, you were issued a label pin, which identifies you as a Member of Congress - You should always wear that pin when working in the Capital.

Also, Cynthia - You should respect those officers, whose job it is to protect your sorry self, enough to co-operate with them. You, as a Member of Congress, are not a 'higher being' who can simply ignore the 'little people' who work so hard to make your life so easy.

Finally, Members of Congress are not above the law. If you had worn your pin, you would have made it to your 'important meeting' without incident. If you had simply stopped and produced identification, when first asked, you would have made it to your meeting without incident.

Cynthia, your actions have shamed the people of the great state of Georgia, once again.
The 'race card' only highlights the ignorance of the person playing it.

We must honestly ask ourselves what is the root cause of this war being waged on our people and our country. I suspect that we will need to look at altering some of our foreign policy positions in some parts of the world. Unless we do this I fear that a military campaign, unsupported by sound foreign policy strategies, will only cause immeasurable civilian suffering throughout the world and may well actually lead to more terrifying attacks upon our cities and our citizenry.

The latest in a series of party policy statements for 2006, the Democrats' national security platform comes seven months before voters decide who will control the House and Senate.

Okay, let's see.
The White House will remain Republican at least till Jan 2009;

(Let's do some math. It takes 67 Senators to remove a President from Office;
currently there are 45 Democrats/55 Republicans;
up for election in 2006 - 18 Democrats/15 Republicans;
Worst case: cleans sweep by Democrats - gives you 60 Democrats/40 Republicans;
Democrats can not remove Pres. Bush from office without Republican help.)

The House and Senate will remain controlled by Republicans at least until Jan 2007.

So, how will the Democrats take charge of the military in 2006?

Generally speaking, those questions focus on whether the Quran does indeed promote violence against non-Muslims, and how many of the terrorists' ideas — about the violent jihad, the self-immolation, the kidnappings, even the beheadings — come right out of the text? But even more specifically:

Is Islam the only religion with a doctrine, theology and legal system that mandates warfare against unbelievers?

Is it true that 26 chapters of the Quran deal with jihad, a fight able-bodied believers are obligated to join (Surah 2:216), and that the text orders Muslims to "instill terror into the hearts of the unbeliever" and to "smite above their necks" (8:12)?

Is the "test" of loyalty to Allah not good acts or faith in general, but martyrdom that results from fighting unbelievers (47:4) — the only assurance of salvation in Islam (4:74; 9:111)?

Notice the last chapter/verse citation 9:111 - looks kinda like a date (9/11/01). Hmmm.

"As these things mount," Gillers says, "a legitimate question could be asked about whether he is compromising the credibility of the court."

So Scalia should recluse himself for repeating his decision from earlier cases because that undermines the cresibility of the court, but Ginsberg is allowed/encouraged to undermine the foreign policy of the United States of America, without underming the court's credibility.

While his remarks about the pledge occurred before the case was on the Supreme Court's docket, here the court was scheduled to hear arguments less than a month after the Freiburg speech. But a closer examination reveals that there is more than meets the eye: Scalia's remarks don't put forward anything different from the views he already articulated in two published opinions, a dissent in Rasul v. Bush and another dissent in Hamdi v. Rumsfeld. And that fact makes all the difference. ...

Supreme Court Justice Ruth Ginsburg gave a speech in South Africa last month, which, for some reason, is just now being publicized. Ginsburg's speech was titled "A Decent Respect for the Opinions of [Human]kind." In it, Ginsburg argued explicitly for the relevance of foreign law and court decisions to interpretation of the American Constitution. Ginsburg did not try to hide the partisan nature of this issue; at one point, she referred to "the perspective I share with four of my current colleagues," and she specifically criticized Justice Antonin Scalia, Judge Richard Posner, and the two bills that were introduced in Congress in 2004 and were broadly supported by Republicans. And she indulged in an outrageous bit of demagoguery, suggesting that those who disagree with her are somehow aligned with Justice Taney's infamous defense of slavery in the Dred Scott case.

So, Sleeping during court business does not undermine the court.
So, Attacking your fellow jurists and the foreign policy of the USA, while in a foreign nation, does not undermine the court.
But, restating your opinions from earlier cases, does undermine the court.
The quacks are the liberals who are determined to turn the USA into a defenseless socialist state.

Convert Must Die

KABUL, Afghanistan (AP) -- Senior Muslim clerics are demanding that an Afghan man on trial for converting from Islam to Christianity be executed, warning that if the government caves in to Western pressure and frees him, they will incite people to "pull him into pieces."

 

"Rejecting Islam is insulting God. We will not allow God to be humiliated. This man must die," said cleric Abdul Raoulf, who is considered a moderate and was jailed three times for opposing the Taliban before the hard-line regime was ousted in 2001.

But three Sunni preachers and a Shiite one interviewed by The Associated Press in four of Kabul's most popular mosques said they do not believe Rahman is insane.

"He is not crazy. He went in front of the media and confessed to being a Christian," said Hamidullah, chief cleric at Haji Yacob Mosque. "The government is scared of the international community. But the people will kill him if he is freed."

"Cut off his head!" he exclaimed, sitting in a courtyard outside Herati Mosque. "We will call on the people to pull him into pieces so there's nothing left."

He said the only way for Rahman to survive would be for him to go into exile.

But Said Mirhossain Nasri, the top cleric at Hossainia Mosque, one of the largest Shiite places of worship in Kabul, said Rahman must not be allowed to leave the country.

"If he is allowed to live in the West, then others will claim to be Christian so they can, too," he said. "We must set an example. ... He must be hanged."

What is so lacking in Islam, that the 'threat of death' is required to keep the faithful?

Reid should listen to Senator Lieberman. Iraq is improving.

Senator Reid -  instead of pandering to a radical base which can not bring about a Democratic majority, you need to create a plan, share a vision for improving this nation and the world.

Senator Reid - the most irresponsible, dangerous, incompetent thing the US could do; is to withdraw our troops from Iraq before their forces are ready to maintain order throughout the country.

Conversion from Islam = DEATH

Rahman faces death for converting to Christianity.

This case exposes problems with the Afgan Constitution..it has a clause which supports Islamic law, and a clause which supports the UN Charter.

      Islamic Law says death to any who convert from Islam.

      UN Charter allows for freedom of religion, including the right to change religions.

Rahman choose to return to Afganistan.

Rahman choose to make an issue out of his religion.

Rahman wishes to be a Christian Martyr. 

 

His wish will be granted, Islam the Death Cult demands it.

 

Rahman is a brave man to die for his beliefs.

Rahman left Afghanistan shortly after the birth of his daughters, now 12 and 13. He and his wife divorced. While overseas, Rahman converted to Christianity. He returned to Afghanistan about three years ago and moved back in with his father and daughters. He left for months at a time, working at a restaurant or as a security guard.

He stayed with cousins, who asked him to leave after he said he was a Christian. Eventually, Rahman moved back with his father.

"He is my son," said Manan, crying. "But if a son does not care about the dignity of his family, the dignity of his father, God can take him away. You cannot make anything out of such a son. He is useless."

He complained about Rahman's behavior to local police, but did not mention his religious conversion. At first, police asked the family to try to resolve its own problems. Then in early February, Rahman showed up at the police station and complained about how his family treated him. While there, he announced he had become a Christian.

Police said they had no choice except sending the case to central police command.

"We knew he had converted, but we didn't want to get involved in religious issues," said Col. Abdul Mohammed, the deputy commander of the police district. "So we filed a report on the family's problems to send to the central police. And he insisted over and over, `Please write in my file that I converted to Christianity.'"

On Thursday, the first day of the trial, Rahman appeared in court with no lawyer. Prosecutor Abdul Wasi said Rahman had been told repeatedly to repent and come back to Islam, but Rahman refused. Wasi called Rahman a traitor.

I have to suffer listening to PBS, to please my bride.

"All Things Considered" started with a 15 minute attack on President Bush.
They discussed his speech in Cleveland.
They talked about the unscripted questions from the audience.
They play the tape of a very difficult and pointed question - Then INSTEAD of playing the President's answer, they EDITORIZED and told us what the Presdient said. They were criticial of his answer. BUT they never played the actual answer from the President.

Then they discussed the political situation in Ohio. According to them the Republicans have no chance at all in Ohio.

Islam is the only 'religion' which has the death penalty for converting out of the faith.

Does Islam offer so little that it requires force to keep the 'faithful'?

Or, is Islam really a cult which demand total submission?

Warning against Islamic totalitarianism brings death threats. On a website an Islamic group has made death threats against the 12 intellectuals, including Salman Rushdie, who recently signed a Manifesto against Islamic Totalitarianism.

According to one of the signers, the French writer Caroline Fourest, the threat was made this Saturday on the website ummah.net. It mentions a who’s who guide and a list of targets scheduled for termination.

The group urges its adherents to take their time but says it should happen soon. It adds that it isn’t necessary to first have a Fatwa from a religious leader, such as the one Ayatollah Khomeini issued in 1989 against Salman Rushdie’s life for having offended the religion.

“The threat is simply not acceptable. Our Manifesto urges to resistance by means of ideas. But the Islamists have answered with threats of violence. A proof - if such was necessary - of their rejection of democratic debate and of their totalitarianism,” Caroline Fourest says.

She adds that the Manifesto isn’t against Islam but against Islamism and the Islamists’ using the religion politically to oppress, for example, Freedom of Speech. She emphasises that the signers will not be subdued by threats.

Random thought.
You might think that I should say that Justice Ginsburg can freely speak her mind.
But she choose to surrender some of her free speech, when she took the seat on the bench. Judges should not discuss matters which may come before their court. A Federal court judge, especially a Supreme Court Justice should not openly attack the policies of the United States, except when writing a court decision. IMHO, Justice Ginsburg has violated judicial ethics and her oath, and she should be impeached.

Justice Ginsburg openly attacks many decisions of the US Courts, and policies of the US, in a foreign country.

This has to be a violation of judicial rules.

Underming the policies of the US Government by a sitting Justice should not be allowed.

She is inciting opinion against the US.

This can not be considered in line with her oath to "..Support and defend the Constitution of the United States against all enemies foreign and domestic.."

She makes direct attacks upon Justice Scalia:

Those words were penned in 1857. They appear in Chief Justice Roger Taney's opinion for a divided Court in Dred Scott v. Sandford, an infamous opinion that invoked the majestic Due Process Clause to uphold one human's right to hold another in bondage. The Dred Scott decision declared that no "descendants of Africans [imported into the United States], and sold as slaves" could ever become citizens of the United States.

While the Civil War and the Thirteenth, Fourteenth, and Fifteenth Amendments to the U.S. Constitution reversed the Dred Scott judgment, U.S. jurists and political actors today divide sharply on the propriety of looking beyond our nation's borders, particularly on matters touching fundamental human rights. Some have expressed spirited opposition. Justice Scalia counsels: The Court "should cease putting forth foreigners' views as part of the reasoned basis of its decisions. To invoke alien law when it agrees with one's own thinking, and ignore it otherwise, is not reasoned decisionmaking, but sophistry."

Another trenchant critic, Seventh Circuit U.S. Court of Appeals Judge Richard Posner, commented not long ago: "To cite foreign law as authority is to flirt with the discredited . . . idea of a universal natural law; or to suppose fantastically that the world's judges constitute a single, elite community of wisdom and conscience." Judge Posner's view rests, in part, on the concern that U.S. judges do not comprehend the social, historical, political, and institutional background from which foreign opinions emerge. Nor do we even understand the language in which laws and judgments, outside the common law realm, are written.

Then she mentions the threat against her: (A year old threat.)

And one not-so-small concern - they fuel the irrational fringe. A personal example. The U.S. Supreme Court's Marshal alerted Justice O'Connor and me to a February 28, 2005, web posting on a "chat" site. It opened:

Okay commandoes, here is your first patriotic assignment . . . an easy one. Supreme Court Justices Ginsburg and O'Connor have publicly stated that they use [foreign] laws and rulings to decide how to rule on American cases.

This is a huge threat to our Republic and Constitutional freedom. . . . If you are what you say you are, and NOT armchair patriots, then those two justices will not live another week.

Nearly a year has passed since that posting. Justice O'Connor, though to my great sorrow retired just last week from the Court's bench, remains alive and well. As for me, you can judge for yourself.

Then she argues with Justice Scalia:

The U.S. Constitution, Justice Scalia has remarked, contains no instruction resembling South Africa's Section 39 prescription. So U.S. courts, he thinks, have no warrant from our fundamental instrument of government to consider foreign law. I would demur to that observation. Judges in the United States are free to consult all manner of commentary - Restatements, Treatises, what law professors or even law students write copiously in law reviews, for example. If we can consult those writings, why not the analysis of a question similar to the one we confront contained in an opinion of the Supreme Court of Canada, the Constitutional Court of South Africa, the German Constitutional Court, or the European Court of Human Rights?

Then she implies that the US has tortured detainees:

Later in December, recognizing the nation's obligations under the Convention against Torture, the U.S. Congress banned cruel, inhuman, and degrading treatment of detainees in U.S. custody. The legislation, however, stops short of explicitly banning evidence elicited by torture from consideration by a military tribunal charged with determining whether a detainee is an enemy combatant.

Then she states that a treaty overrides the US Constitution:

I looked to two United Nations Conventions: the 1965 Convention on the Elimination of all Forms of Racial Discrimination, which the United States has ratified; and the 1979 Convention on the Elimination of All Forms of Discrimination Against Women, which, sadly, the United States has not yet ratified. Both Conventions distinguish between impermissible policies of oppression or exclusion, and permissible policies of inclusion, "temporary special measures aimed at accelerating de facto equality." The U.S. Supreme Court's decision in the Michigan Law School case, I observed, "accords with the international understanding of the [purpose and propriety] of affirmative action." (South Africa's Constitution is clear on that matter; Section 9(2) provides: "To promote the achievement of equality, legislative and other measures designed to protect or advance persons, or categories of persons, disadvantaged by unfair discrimination may be taken.")

This irrational fringe must be stopped.

Censure motion to committee

Senator Feingold's misguided Censure Motion has been assigned to committee, where it should die a quiet death.

 

The committee is supposed to conduct a thorough investigation of the NSA program. Good. I hope it does, cause an honest investigation will show that the program is legal. That the monitoring of possible hostile communications is proper conduct by the President, especially when those communications could be the trigger for an attack on American soil.

 

Senator Feingold has signaled his complete disregard for the safety and security of Americans.  

 

Senator Feingold thinks that terrorism is simply a criminal justice matter. He is dead wrong. Al Qaeda has declared war on the United States (1998). The US is at war with Al Qaeda and its allies. The wartime 'stop-loss clause' of our military contracts is in effect. We are prosecuting a war, not fighting crime. Monitoring hostile communications should be expected in time of war. 

 

The latest Al Qaeda threat targets Arizona. So, I would expect that the NSA would be actively seeking to intercept communications that might relate to an attack in the State of Arizona. And if this involves the incidental intercept of innocent calls between Americans, I would expect the NSA to delete those calls from its files and fine tune the intercept program to reduce the chances of listening to innocent calls. 

 

But the program must continue. We must have an active defense.

Senate Majority Leader Bill Frist just released this statement:

"Senator Feingold should be ashamed of this political ploy. This is another example of the Democrats' failure to establish an agenda that meets the needs of the American people. Senator Feingold's time would be better spent putting forth constructive ideas rather than using cheap political tricks that compromise America's national security by sending a dangerous signal of disunity around the globe.

"The American people are squarely behind the president in fighting the War on Terror. This stunt sends a dangerously wrongheaded message, and the Senate, on a bipartisan basis, ought to reject the Feingold resolution."

Censure the President for Defending the USA

Article 2 of the US Constitution grants broad powers to the President.
The Authorization of Military Force in 2001 and again 2003 - has Congress authorizing the President to use all force.

The NSA program of monitoring possible terrorist communication between a person in the US and a person outside the US.
Is legal. (Innocent until proven guilty beyond a reasonable doubt.)
And has been closely monitored by the FISA Court and the 'Gang of 8' on Capital Hill.

Plus, most Americans support the program.

Senator Feingold's action will only serve to 'get out the Republican vote in November'.
This action serves notice that elections matter.
This action shows that Democrats only want to play politics.
This action highlights that President Bush is willing to go the distance to defend America.

After Fund wrote about the subject, others openly criticized Yale for its acceptance of a man who participated in one of the most brutally oppressive governments in recent history, and some of those critics are alumni of Yale. In response, Yale Law School's assistant director of giving (which means, in the Orwellian lingo of academia, receiving) sent an e-mail to two alumni asking them if they had suffered brain damage:

Purported "Al-Qaeda Undercover Soldier, U.S.A": Last Warning to American People - Two Operations Will Occur; Your Homeland Security Agency Must Surrender; States Far Away From Washington, D.C. Such as Arizona Will Be Hit; We Await Orders From Our Commander Osama Bin Laden; America Will Be Brought to its Knees

On March 10, 2006, the Global Islamic Media Front (GIMF) posted, on the Islamic websites, a final warning to the American people, on behalf of "Rakan Ben Williams" who defines himself as "Al-Qaeda under cover soldier, USA [sic]."

It is not clear exactly who is behind this name. Moreover, according to a previous statement by GIMF public relations bureau director Saif Al-Din Al-Kinani on the GIMF Internet newscast Sout Al-Khilafa, GIMF is not affiliated with Al-Qaeda. [1]

But on November 8, 2005, the London daily Al-Sharq Al-Awsat reported: "The Global Islamic Media Front has threatened [the West] on the Internet by means of its new soldier, whom it calls Rakan Ben Williams, and whom it claims is a white Englishman who converted to Islam." [2]

Also, on November 24, 2005, the GIMF posted on the Islamic websites a similar warning, under the same name, that included an explicit threat to assassinate Italian Prime Minister Silvio Berlusconi, Australian Prime Minister John Howard, Japanese Prime Minister Junichiro Koizumi , British Prime Minister Tony Blair, and U.S. President George W. Bush, when the time comes, with a clear mention of the possibility of doing so after they complete their current terms of office. Although this communiqué was directed to these leaders, it noted that it referred to all Western leaders, and included special mention of Berlusconi. At its conclusion, the communiqué said that it had been written by "the one who thirsts for the blood of the Crusaders, the secret soldier of Al-Qaeda, Rakan Ben Williams, Italy (the Vatican)." [3]

In the following warning, Rakan Ben Williams warns that, unlike after the 9/11, Madrid, and London attacks, which are still being investigated, "[after] the coming attack there will be no one to analyze and investigate, because the mind and the heart will be unable to comprehend it… This will not be a single operation", the report added, "but two; one bigger than the other, but we will begin with the big one and postpone the bigger one, in order to see [how] diligent the American people is [in preserving] its life. If it chooses life, [it must] carry out the demands of the Muslims, and if it chooses death, then we are its best perpetrators." The warning appeared in Arabic and in English.

Reader Maria L. C. sends an update on a case I blogged about last year--the schoolgirl who was sent home for wearing red, white, and blue jewelry she handcrafted as a tribute to her relatives in the military. The student, Raven Furbert, is suing the school district and the case has advanced:

A 13-year-old Mont Pleasant Middle School student who sued Schenectady school officials for the right to wear a red, white and blue necklace can move her case forward.

U.S. District Judge Lawrence Kahn ruled Tuesday that constitutional issues in the case should be further explored and addressed later, perhaps at trial.

The student, Raven Furbert, filed the civil rights violation claim in U.S. District Court in February 2005, after school officials banned her from wearing a necklace she made to honor soldiers serving overseas, such as her uncle and three other relatives.

School officials had asked for the case to be dismissed, saying the neck wear violated rules on potential gang-related items.
